Ken and Johnny look at Fair Lending with an overview of ECOA, FHA, & HMDA. Focus of class is on “Disparate Treatment” because this is where loan officers have discretion. We also cover Cognitive Biases that loan officers should be aware of to ensure fair treatment of consumers. The Townstone Lawsuit (in process = allegations only) is used as an example of possible fair lending violations. Loan officers should be informed of the dangers of making edgy humor a part of anything that goes public. Also, no fair lending carve out for a person of a certain demographic (Canadian-American) making Canadian jokes.
